This letter confirms verbal notification to you on May 08, 2013, at 1030 by Dr. Larry Davis, Deputy District Manager (DDM), Philadelphia District Office, of our decision to place the Notice of Suspension (NOS), issued to your firm on May 03, 2013, in abeyance. PSIS is providing you with this Notice of Suspension Held in Abeyance based on your establishment’s proposed corrective actions and preventative measures. PSIS determined that the suspension action will be placed in abeyance and the assignment of inspection will resume, pending PSIS verification ofthe adequacy of your humane handling program in achieving regulatory compliance. PSIS will be verifying your actions to ensure that your establishment effectively implements the proffered corrective actions and preventative measures. This letter provides you with the chronology of events and conclusions, including your responsibility.

NOTICE of SUSPENSION:

This letter confirms verbal notification by Dr. Larry Davis, Deputy District Manager (DDM), to Mr. John Wing at 11:00 AM, on May 03, 2013, of the Food Safety and Inspection Service’s (FSIS) decision to suspend the assignment of inspectors for slaughter operations at your establishment #31561M, The Meat Shop located in Bensen, VT. FSIS determined that your establishment has failed to handle animals humanely, resulting in the commission of an egregious act. Your establishment is not in compliance with Title 9 of the Code of Federal Regulation (9 CFR) Parts 313.2(f), 313.16(a)(1) and (3), and 313.16(b)(1)(i) and(iv) and (2). We are taking this action in accordance the Federal Meat Inspection Act (FMIA) [21 U.S.C 603], and the Rules ofPractice in (9 CFR) Part 500.3(b).
