This serves as official notification by the Food Safety and Inspection Service (FSIS) ofour decision to reinstate the suspension ofthe assignment ofinspectors for the third time for your slaughter operation at establishment 09173M, Brooksville Meat Fabrication, Brooksville, KY 41004. This action is based on your establishment’s failure to handle livestock humanely according to 9 CFR Part 313. On April 30, 2013, a “Notice of Suspension” was issued to suspend the assignment of inspectors at Brooksville Meat Fabrication Est. 09173M. On May 7, 2013, a “Notice of Suspension Held in Abeyance” was issued to your establishment. In the “Notice of Suspension Held in Abeyance” you were made aware that failure to comply with regulatory requirements or to effectively implement your proposed actions that formed the basis for the abeyance could result in the immediate suspension ofinspection at your establishment. In addition, on June 19, 2013, a “Notice ofReinstatement of Suspension” was issued to suspend the assignment ofinspectors at your establishment for failure to handle livestock humanely. On June 21,2013, a “Notice of Suspension Held in Abeyance” was issued to your establishment. In the “Notice of Suspension Held in Abeyance” you were again made aware that failure to comply with regulatory requirements or to effectively implement your proposed actions that formed the basis for the abeyance could result in the immediate suspension ofinspection at your establishment. Subsequently, on August 9, 2013, a “Notice of Suspension Held in Abeyance” was again issued to your establishment. In the “Notice of Suspension Held in Abeyance” you were made again aware that failure to comply with regulatory requirements or to effectively implement your proposed actions that formed the basis for the abeyance could result in the immediate suspension ofinspection at your establishment. Additionally, on September 9, 2013, your establishment was issued a “Notice of Show Cause” letter from FSIS Office oflnvestigation, Enforcement and Audit-Enforcement and Litigation Division, Washington, DC, giving you an opportunity to provide information as to why FSIS should not initiate action to indefinitely suspend or withdraw inspection service at 09173M, Brooksville Meat Fabrication, Brooksville, KY 41004. Finally, Non-Compliance Reports (NRs) were written on November 11, November 27, 2012 and July 30, August 7, August 9, August 26, September 13, and October 2, 2013, for various humane handling non-compliances involving failure to provide water, food, slips/falls, and stunning mishaps.

NOTICE of SUSPENSION HELD in ABEYANCE:

On August 9, 2013, the Food Safety and Inspection Service (FSIS) issued to your Establishment, Brooksville Meat Fabrication, Est M9173, a “Notice of Reinstatement of Suspension” letter. This notice was based on your establishment’s failure to handle livestock humanely according to 9 CFR Part 313. Your establishment failed to effectively render the animal insensible on the first attempt and also failed to take immediate corrective actions to render the animal insensible after the first shot. Following the verbal notification of the snspension reinstatement, you were telephonically contacted by Jackson District Office (JDO) Deputy District Managers (DDM) Perry Davis and Donald Coley to ensure you had received the faxed copy ofthe Notice ofSuspension Reinstatement. You were informed by Donald Coley that you needed to submit a response in writing to the District Office to Dr. Paul Resweber’s attention and it would be reviewed. You stated that you would submit a response to the district office over the weekend or on Monday.

On April 30, 2013 a “Notice of Suspension” was issued to suspend the assignment of inspectors at Brooksville Meat Fabrication Est. 09173M. On May 7, 2013, a “Notice of Suspension Held in Abeyance” was issued to the establishment. In the “Notice of Suspension Held in Abeyance” you were advised or made aware that failure to comply with the regulatory requirements or to effectively implement your proposed corrective actions that formed the basis for the abeyance may/would result in the immediate suspension of inspection at your establishment or appropriate actions to be taken. Therefore, on June 19, 2013 the establishment was served official notification by the Food Safety and Inspection Service (FSJS) ofour decision to reinstate the suspension of the assignment of inspectors for your slaughter operation at establishment 09173M, Brooksville Meat Fabrication, Brooksville, KY 41004. This reinstatement of suspension was based upon the June 19, 2013 failure of your establishment to effectively stun a hog on first attempt and also the failure to render immediate and effective con-ective actions. Additionally, on June 20, 2013 your first response was to render a newly proposed slaughter chart with headings referring to “artillary” and also failing to stipulate the details of the usage of your newly proposed abbreviations, S, SG, and R. Subsequently, you proffered at 0742 on June 21, 2013 a revised chart with only one column corrected from “atiillary” to “stmming equipment”, per regulatory approved methods ofstunning. And ultimately, you corrected all columns stating “artillary” with the acceptable language of “stunning equipment” at approximately 0808 June 21,2013.

On April30, 2013, the Food Safety and Inspection Service (FSIS) issued to your Establishment, Brooksville Meat Fabrication Est. 09173M, a “Notice of Suspension Letter”. This notice was based on your establishment’s failure to handle livestock humanely according to 9 CFR Part 313.
Following the suspension action on April30, 2013, you provided FSIS with written corrective and preventative actions in an effort to meet the requirements of the Humane Slaughter Act. The responses received on May I, May 2, and the first response received on May 6, 2013 did not meet the requirements of the Humane Slaughter Act. Specifically, your responses did not proffer immediate corrective action, long term preventative action, training for employees, or the type of weapon(s) that would be used based on the size and weight of the animals. Therefore, the suspension remained in effect.

NOTICE of SUSPENSION HELD in ABEYANCE:

On July 11, 2013, a “Notice of Suspension” was issued to suspend the assignment of inspectors at C & W Meat Packers, Est. M21190. This action was based on your establishment’s failure to handle livestock humanely according to 9 CFR Part 313. Your establishment failed to effectively render the animal insensible on the first attempt and also failed to take immediate corrective actions to render the animal insensible after the first shot.

Following the suspension, on July 25, 2013, you contacted the Jackson District Office (JDO) telephonically, and spoke with Deputy District Manager (DDM) Don Coley to discuss the suspension. You stated that you were having a gate built to enable secure stabilization of the animals prior to stunning and that you were in the process of providing a training plan. You were informed that all materials such as training logs, and etc. would need to be signed by the employees being trained either as a refresher training or new employee training. On August 8, 2013, you provided FSIS with written corrective and preventative measures in an effort to meet the requirements of the Humane Slaughter Act. At approximately 0900 hours, on August 8, 2013, Mr. Don Coley, DDM, notified you telephonically that the corrective and preventative measures were received in the District Office and meet the requirements to place C &W Meat, Est. M-21190 under a “Notice of Suspension Held in Abeyance.” This letter is to formally inform you of this action.

NOTICE of SUSPENSION HELD in ABEYANCE:

On October 23, 2013 a “Notice of Reinstatement of Suspension” was issued to suspend the assignment of inspectors at The Chop Shop, Est. M44151. This action was based on your establishment’s failure to handle livestock humanely according to 9 CFR Part 313. This reinstatement of suspension was based upon your establishment’s failure to render the animal unconscious on the first attempt using the captive bolt gun. On October 25, 2013, you provided your first response which included an improved head catch and a stunning procedure. Additional information was requested for the Stunning section that could not be completed until the newly installed equipment was in operation and tested. Also, questions were asked about whether the correct stunning equipment for the classes of animals slaughtered was correct and a training roster was requested to demonstrate that employees were trained. On October 31, 2013, you submitted a second response which included a statement that was unclear regarding explanation that animals will only be shackled, hoisted, cut and bled after an animal is made insensible. Also, a statement concerning the location of the mark to be made on an animal’s head shall be consistent with industry standards was requested. On November 1, 2013, the Jackson District received the modifications which were acceptable. On November 1, 2013, at 0720 hours, Mr. Coley notified you telephonically that the latest faxed corrective and preventive actions received in the District Office meet the requirements to place The Chop Shop, Est. M44151 back under “Notice of Suspension Held in Abeyance” at this time. This letter is to formally inform you of this action.

October 18, 2013, Mr. Don Coley, DDM, notified you telephonically that the corrective and preventative measures were received in the District Office and meet the requirements to place The Chop Shop, Est.
