NOTICE of SUSPENSION HELD in ABEYANCE:

On April 24,2013, the Food Safety and Inspection Service (FSIS) notified you ofthe suspension of the assignment of inspection personnel at your facility. This Notice ofSuspension was based on Regulations 9 Cf.R 500.3( I)(6) and 9 CFR 500.3(b), Rules of Practice. This action was based on your establishment’s failure to prevent inhumane handling of livestock at your facility as required by 9 CFR 313.16(a)(1) and 9 CFR 3 J3.16(a)(3), as well as actions by establishment personnel that may be viewed as intimidation and interference with an FSJS employee.

On April 25,2013, you provided a written response to the Notice of Suspension via email. Upon review of your action plan, FSJS requested clarifications which you provided on April 26, 2013. FSIS analyzed the corrective and preventive measures provided in the final revision of the action plan, which included actions to prevent the recurrence of inhumane handling of livestock and assurances that all establislunent personnel understand what constitutes intimidation and that such action will not be permitted. FSJS will hold the suspension in abeyance pending verification by FSIS pers01mel that your action plan is effectively implemented.
