NOTICE of INTENDED ENFORCEMENT:

This letter provides official notification and confirms verbal notification provided to you by [redacted] on July 16, 2013, at approximately 1200 hours, of the Food Safety and Inspection Service (FSIS) intent to suspend the assignment of inspection program personnel for the slaughter process at your establishment located at 1301 New Savannah Rd., Augusta, GA 30901, for failure to effectively implement humane methods of slaughtering and handling of animals in a manner that complies with the regulatory requirements prescribed by the Federal Meat Inspection Act (FMIA) and Humane Methods of Slaughter Act (HMSA), as outlined below. Title 9 of the Code of Federal Regulations (9 CFR), part 500.3(b) states that FSIS may impose a suspension without providing prior notification because the establishment is handling or slaughtering animals inhumanely.

Citation: At approximately 1030 hours, while performing an operational sanitation verification  procedure, the following non-compliance  was determined at the regulated  establishment by [redacted]: The deficiency was noted  in the processing room .  Pork meat and heads were being placed  on a rack/shelf  that had black residues on it. Also, one employee was seen picking up pork product from the floor and placing it on the bottom  shelf of the processing table next to a hack saw blade.  This deficiency is in direct violation of the regulatory requirement of the Meat and Poultry Regulations 9 CFR 416.4 (b), which  states in part that “Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration  of product”. [redacted] was immediately informed  of this non-compliance .

Regulation:

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.13(b) Each official establishment shall conduct all other procedures in the Sanitation SOP’s at the frequencies specified.
