Violation:  381.65(e), 417.2(c)(4)

Citation:  While performing a Food Safety 10 bird test on line # at approximately 05:04hrs, I observed fecal inside bird #8. I notified of the 03J01 noncompliance. The fecal, greenish in color and 1/4 inch in size, was located in the kidney area and had a gut attached. The establishments immediate corrective action was to show the sorters the bird and asked them to remove birds with guts attached from the line. A HACCP retest was performed at 05:13hrs and found to be acceptable. The affected bird was washed at the product wash station and placed on the line prior to the rinse. No regulatory action was taken because the establishment followed their HACCP corrective action plan. The establishments further preventive measures were to council the sorters on the importance of removing birds with guts attached and if the problem continues further disciplinary action will be taken. The 03J02 was performed and found to be acceptable. A fecal noncompliance was observed on 08/30/2010, see NR#0253-2010. This document serves as written notification that your failure to comply with regulatory requirements of 9 CFR 381.65(e) and 417.2(c)(4) could result in additional regulatory or administrative action as described in 9 CFR 500.4.

Regulation:

381.65(e) Poultry carcasses contaminated with visible fecal material shall be prevented from entering the chilling tank.

417.2(c)(4) List the procedures, and the frequency with which those procedures will be performed, that will be used to monitor each of the critical control points to ensure compliance with the critical limits;
