Citation: At approximately 0530 hrs. I observed the following noncompliance while performing the review and observation procedure in the live receiving/picking room department. At the start of operations (0500 hrs.)this morning while processing the first lot of organic chicken, the lines was decreased in speed for air-sac condition. At that time I proceeded to the live receiving/picking room department to observe operational sanitation conditions being maintained. When I arrived in the departmentI observed the following conditions, all the holding tanks were filled to capacity, the rehang conveyors were over flowing with organic chicken carcassesfalling on the floor, and an excessive amount of organic chicken carcasses were on floor on both sides of the rehang conveyor where the employees were standing and stepping on them while they were hanging organic chicken on the evisceration lines. I notified the picking room department supervisor of the noncompliance and informed him to condemn all the organic chicken carcasses that the employees were stepping on, approximately two barrels were condemned. I notified him that all chicken carcasses that fall on the floor must be recovered and reconditioned immediately and that sanitary conditions must be maintained to prevent product from falling on the floor. He informed me that he had previously stopped the kill line and proceeded to restart it when allthe chicken carcasses were recovered from the floor. I instructed him to keep the kill line off until all the holding tanks of chicken were worked back into the process. After the holding tanks were emptied and sanitary conditions were restored I instructed to start the kill line. After a review of the SSOP records for the live receiving/picking room department, no deficiencies were documented prior to my observation. This document serves as a written notification that failure to comply with regulatory requirements could result in additional enforcement action described in 9 CFR part 500.

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.15(a) Each official establishment shall take appropriate corrective action(s) when either the establishment or FSIS determines that the establishment’s Sanitation SOP’s or the procedures specified therein, or the implementation or maintenance of the Sanitation SOP’s, may have failed to prevent direct contamination or adulteration of product(s).
