Citation: On 06/13/2011, at approximately 0730 hours, after the east line cropper had broken down and maintenance had repaired the equipment. I observed a maintenance employee standing on the machine shield bar above the product, which had entered the equipment. The line had been stopped for adjustment by production. I notified Mr. (Acting Maintenance Manager), Mr. (Third Shift Maintenance Supervisor), Mr. (First Processing Manager), (Evisceration Supervisor) of the product contamination. I took regulatory control action by having FI Anthony Snyder depress his control switch at post-mortem inspection station so that the line could not start until the product could be removed from the line and the machine could be re-sanitized. The product was retained in a red barrel to which I applied US Retained tag # B40197857. The product was reconditioned and re-inspected by USDA and released to production at 0750 hours. I notified Mr. , Mr. and Mr. that a NR would be issued for this noncompliance. This is a violation of 9 CFR 416.4(d). This practice by the maintenance employees has been discussed in plant meetings several times in the last two months. The establishment has received both oral and written notification of this noncompliance. Failure to comply with regulatory requirements could result in further administrative action as described in 9 CFR part 500.

Regulation:

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
