Violation: 381.71(a), 416.4(d)

Citation: At approximately 0905 and 0950 hours, I inspected one chicken carcass and one chicken carcass, respectively, which I determined to be DOAs. Each carcass was cold to the touch, had an extremely foul odor, and had degenerative changes of the gall bladder and reddening of the skin indicative of a bird that had not died by slaughter. I showed the unwholesome carcasses to First Processing Manager and stated than a NR would be issued. At 0950 hours, while I was notifying Ms. another carcass was removed from the evisceration line at station W1 which had not been slaughtered, and therefore drowned in the scalder tank as a cadaver. Poultry that dies other than by slaughter is considered adulterated [21 USC 453(g)(5)]. DOAs are prohibited from being dressed or conveyed into areas of the establishment where poultry products are prepared or stored [9CFR 381.71(a)]. Their presence in the evisceration department exposes product to insanitary conditions in violation of 9CFR 416.4(d).

Regulation:

381.71(a) Birds plainly showing on ante mortem inspection any disease or condition, that under §§ 381.80 to 381.93, inclusive, would cause condemnation of their carcasses on post mortem inspection, shall be condemned. Birds which on ante mortem inspection are condemned shall not be dressed, nor shall they be conveyed into any department of the official establishment where poultry products are prepared or held. Poultry which has been condemned on ante mortem inspection and has been killed or died otherwise shall under the supervision of an inspector of the Inspection Service, be disposed of as provided in § 381.95.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
