Violation: 416.4(d)

Citation: At approximately at 1100 hours, I inspected one (1) chicken carcass. I determined the carcass as a DOA. The carcass was held by on-line inspection program personnel (IPP), in the evisceration department, for my exmination. The DOAs must be removed from the live chicken before hanging the live chicken on the live-hang line. The DOAs cause insanitary conditions and are not allowed in the production department per 9CFR 381.71. The product must be protected in accordance with 9 CFR 416.4 (d) that states "Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishment." Poultry that die otherwise than slaughter are adulterated under 21 U.S.C. 453 (g)(5) of the Poultry ProductsInspection Act (PPIA). Under 21 U.S.C. 458 (a)(1) of the PPIA it is a prohibited act to process any poultry products that are capable of use as human food except in compliance with the requirements of the law. Please refer to a similar NR 0067-2011 dated 8-24-2011.
