Violation: 416.1, 416.4(a)

Citation: At approximately 0710 hours, while waiting to perform a test at the Reprocessing Station, Dr. (IIC) calls me to the West Line Rehang area in the Evisceration Department. I observed excessive amount of blood, feathers and fecal materials on the inside bottom and sides product contact surfaces in a black tank location by the west wall near west rehang conveyor belt. Further examination, I observed a chicken head, large amount of blood, feathers and six to seven drop of fecal materials on the inside bottom and sides product contact surfaces of a black tank location by the west rehanger. I rejected the two black tanks for unsanitary condition with US Rejected Tags B39 801329 and B39 801332. The black tanks in the evisceration department are use to place the whole birds in from the rehang conveyor belt doing operation. I informed (1st Processing Manager) and (Evisceration Supervisor) of my observation. After the two black tanks were recleaned and sanitized, I relinquished the regulatory control actions on the two black tanks at approximately 0725 hours. A check of the plant SSOP's forms, plant's Operational Sanitation records and GMP Monitor's records (Evisceration) shows no documentation for the above noncompliance's on 09/01/2010. Establishment management has received oral and written notification concerning this noncompliance. The Establishment Operational Sanitation and Sanitary Conditions which states under Objective: " ". The noncompliance involved no direct products cross contamination. This is a failure to comply with 9 CFR 416.1, as well as 9 CFR 416.4(a). This document serves as a written notification that your failure to comply with regulatory requirement could result in additional enforcement action described in 9 CFR part 500.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
