Citation: On June 21, 2011 at approximately 1240 hours, Inspector [redacted] and I (Dr. [redacted] observed the following noncompliance. In the kill floor: a cockroach, of approximately 1 cm in length, was on the top surface of one of the moving viscera trays. A second cockroach, of approximately 1 cm in length, was crawling on the bottom surface of the trays. I took regulatory control action and applied a US Reject tag # B43736013 to the moving trays table. [redacted] QC, was notified of the noncompliance. Upon notification [redacted] removed the cockroaches, cleaned and sanitized the area. After ensuring that the area was cleaned and sanitized I removed the US Reject tag and released the area for use. The establishment is not in compliance with 9 CFR 416.1 and 9 CFR 416.2(a). This noncompliance is linked to a noncompliance of similar cause, record # 0030-2011-19535, dated 06/09/2011. Previous preventative measures to prevent recurrence were ineffective or improperly implemented. This document serves as written notification that your failure to comply with regulatory requirements could result in additional regulatory or administrative action.


416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(a) Grounds and pest control. The grounds about an establishment must be maintained to prevent conditions that could lead to insanitary conditions, adulteration of product, or interfere with inspection by FSIS program employees. Establishments must have in place a pest management program to prevent the harborage and breeding of pests on the grounds and within establishment facilities. Pest control substances used must be safe and effective under the conditions of use and not be applied or stored in a manner that will result in the adulteration of product or the creation of insanitary conditions.
