Citation: On 14 October 2010, at approximately 0931 hrs, whilst performing an unscheduled ISP procedure code 06D01 (Facilities & Equipment), Dr [redacted] FLS of the Sunbury Circuit, Dr [redacted] the Line Inspector at Est 20760, and I ([redacted] DVM, MRCVS), identified the following noncompliances in the truck trailer that comprises the dry storage area immediately off of the offal room: (1) The aluminum ceiling of this area, which is also the ventral surface of the interior top surface of the truck trailer, contained condensation throughout its entire surface that was dripping onto cardboard packaging boxes that awaited assembly; (2) The plywood surface of the interior walls and floor were damaged to the point that there are numerous abrasions and holes throughout; in some cases, the extent of the damage was so severe that there were holes to the outside of this trailer that exceeded 10 cm in diameter and allowed outside light to enter this aforementioned truck trailer. I took immediate regulatory control action and affixed US Rejected/US Retained tag number B39443935 to the opening of this truck trailer, which is also the interface between this truck trailer and the furthest extent of the offal room. [redacted] Jr was notified of these noncompliances at approximately 0933 hrs. The establishment wiped down all condensation and removed and discarded the top layer of cardboard boxes, these having been adulterated by condensation. Additionally, the establishment covered the remaining boxes with a layer of plastic and covered all holes in the plywood, pending further repairs to this heavily damaged sheathing. I reviewed the establishment's actions, deemed them to be satisfactory (at approximately 1054 hrs), and removed the retain tag and released the area. The establishment is not in compliance with the following regulations: 9 CFR 416.1, which states the following: "Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated."; 9 CFR 416.2(b)(1), which states the following: "Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions."; 9 CFR 416.2(b)(2), which states the following: "Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions."; 9 CFR 416.2(b)(3), which states the following: "Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice."; 9 CFR 416.2(d), which states the following: "Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided." This noncompliance is linked to a noncompliance of similar nature, noncompliance number 56-2010-13030, dated 27 September 2010.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.

416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice.

416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.
