Violation: 303.1(b)(3)

Citation: At 7:30 a.m. while performing a scheduled 06B01 the following non-compliance was found. Review of the custom exempt book indicated that no animal had been slaughter for custom exempt for Saturday 8/7/2010. Further investigation revealed that one beef cow slaughtered under USDA inspection was used for both USDA and custom processing. One half of this beef cow was processed under USDA inspection on Friday and the second half of the cow was processed as custom on Saturday for plant employees. Further investigation revealed that no pre-operational or operational records were kept for the Saturday processing. The name, and address of the owner had not been recorded and there was no record of what product was produced on Saturday. Records did indicate that all SRM's had been removed and that no custom product went to anyone other than plant employees. These violations are recordkeeping and implementation errors and no food product from the custom processing enter commercial channels. There are no other violations of this nature in the last 90 days.

Regulation:

303.1(b)(3) The custom operators claiming exemption under paragraph (a)(2) of this section shall keep records, in addition to records otherwise required by part 320 of this subchapter, showing the numbers and kinds of livestock slaughtered on a custom basis, the quantities and types of products prepared on a custom basis, and the names and addresses of the owners of the livestock and products.
