Citation: At approximately 0815 hours while performing unscheduled ISP code 04B04 on a batch of Beef and Lamb Donner I observed the following noncompliance. A check of the generically approved label on file, the label that was to be applied to the product, and the ingredients used showed differences in the yogurt component listing. The approved label stated the component of the yogurt was (cultured pasteurized milk, whey protein concentrate, pectin, yogurt culture). The yogurt component breakdown of the label that was to be applied to the product listed (cultured pasteurized milk, pectin). The yogurt component breakdown of the 2 yogurts being used in the formulation was: James Farm yogurt: (cultured pasteurized grade A milk, concentrated skim milk, natamycin ( a natural mold inhibitor). Chobani yogurt: (cultured pasteurized nonfat milk, live and active cultures, S thermophilis, L bulgaricus, L acidophilus, bifidus, L casel). The generically approved label on file was generically approved from label approval # 2546862. The actual sketch approved label was not on file. No affected product was labeled incorrectly. I informed Mr. [redacted] during the formulation of the noncompliance orally and in writing with this NR. This is a violation of FSIS regulations 317.2(j), 317.5, & 317.8.

Regulation:

317.2(j) Labels of any product within any of the following paragraphs shall show the information required by such paragraph for such product

317.5(a)(1) An official establishment or an establishment certified under a foreign inspection system, in accordance with part 327 of this subchapter, is authorized to use generically approved labeling, as defined in paragraph (b) of this section, without such labeling being submitted for approval to the Food Safety and Inspection Service in Washington or the field, provided the labeling is in accordance with this section and shows all mandatory features in a prominent manner as required in § 317.2, and is not otherwise false or misleading in any particular.

317.8(a) No product or any of its wrappers, packaging, or other containers shall bear any false or misleading marking, label, or other labeling and no statement, word, picture, design, or device which conveys any false impression or gives any false indication of origin or quality or is otherwise false or misleading shall appear in any marking or other labeling. No product shall be wholly or partly enclosed in any wrapper, packaging, or other container that is so made, formed, or filled as to be misleading.
