Citation: On 07/27/2010, at approximately 1000 hours I observed the following noncompliance: In the lower level of the plant were the processing of RTE product is done, I observed in the Raw Cooler, about five (5) ceiling tiles had formed condensation on the outside and also was absorbed and held in the ceiling material. I noticed two (2) of the five (5) ceiling tiles slowly dripping water to the floor. While doing this observation no product was adulterated from the dripping condition. I immediately notified and showed Mr. [redacted] of the noncompliance. Regulation 416.2(d) states, ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided. This document serves as written notification that your failure to comply with the regulatory requirements could result in additional regulatory or administrative action. You are hereby advised of you right to appeal this decision as delineated by 306.5 and/or 381.35 of 9 CFR.

Regulation:

416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.
