Citation: On Monday 10/18/2010, while performing pre-operational sanitation inspection at approximately 0730, I observed the following in the processing room: The storage rack located beside the patty machine and which is used to store plastic bags, labels, and other packaging material is showing signs of rust and is in a poor state of repair. No product was involved and no regulatory action was taken. I informed [redacted] of this observation. This does not comply with regulation 416.2(b)(1). This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.

Regulation:

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.
