Citation: At 1200 hrs. on the day of 08/06/2010 I performed the unscheduled task of 06D01 of the facility the following noncompliance's were observed on the kill floor. 1) there is glazed tiles broken or missing on the walls. 2) The steel I beam that holds the electric hoist for the carcasses has rust forming on it. 3) The carcass rail support beam has a spot that the metal has been ripped by the chain from the hoist. 4) The sheet metal corner guard needs caulked around the edges. 5) The wall paint above the tile is peeling or flaking throughout. 6) Flaking paint around windows and some dead flies laying on window seal. I then proceeded to notify the owner Malcolm Koontz of the noncompliance. I then checked the plants records for documentation and found none. This is in violation of regulation 416.1 which states that: Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated. I then checked for similar NR's and found 2 for this root cause. 1) NR # 0009-2010 on 06/18/2010 2) NR # 0010-2010 for 06/25/2010. With this written document, [redacted] will have been notified in writing and orally of the said noncompliance's. This document serves as written notification that your failure to comply with regulatory requirements could result in additional administrative and regulatory actions. You are also advised of your right to appeal this decision as delineated by 9 CFR 306.5 and/or 381.35.
Regulation:
416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.
416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.
416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.
416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.
