Citation: October 16, 2011 08:03 hours While performing an unscheduled, 01C02, operational sanitation inspection procedure of the establishment's evisceration department immediately upstream of the inside/outside bird wash (IOBW) machine, I observed an unknown liquid dripping from the opening of the second manual lung gun's stainless steel nozzle, a direct food contact surface, and at the union of the vacuum system's blue tubing and the gun itself, contaminating its metal handle, a non-food contact surface. The fluid was milky in color and had an odor of decaying organic material. I rejected the lung gun by affixing the Food Safety and Inspection Service's Form 6502-1 #B40157502. Young chicken carcasses were present in the department at the time of discovery but none had yet reached this location in the process on the principle production line or come into contact with the rejected piece of equipment. No edible product was observed to have been involved at this time. According to the firm's preoperational inspection SSOP forms, the lung gun had been inspected and passed at approximately 07:30 hours. The forms had been annotated and authenticated by an authorized employee. This constitutes a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Animals and Animal Products, Subchapter E, Regulatory Requirements under the Federal Poultry Products Inspection Act, Part 416, Sanitation, Sections 13(a) and 13(c). The evisceration department's junior manager, Mr. [redacted] promptly was informed of the noncompliances verbally. Federally-inspected food production establishments are required to fulfill the expectations of all applicable requirements of the United States Code of Federal Regulations and Food Safety and Inspection Service. In this instance, management failed to prevent liquid from escaping the vacuum system and contaminating non-food and direct food and contact surfaces during operations. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).

Regulation:

416.13(a) Each official establishment shall conduct the pre-operational procedures in the Sanitation SOP’s before the start of operations.

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.
