Citation: October 16, 2011 16:32 hours While performing an unscheduled, 01B01, preoperational sanitation recordkeeping inspection procedure, I observed that a member of management had annotated, dated, and initialed the processing preoperational inspection form for 10/12/2011. The data had been authenticated by the processing department's co-manager, [redacted] at 07:39 hours. The form indicated that a preoperational inspection was not performed on the mechanical separating machine. After reviewing a HACCP recordkeeping form, also dated 10/12/2011, I determined that mechanical separation of young chicken product had been performed and that the resulting product registered a temperature of [redacted] degrees Fahrenheit at 11:10 hours. According to the establishment's records, all product processed in this department was done so within the stated Critical Limit for temperature-based Critical Control Point #4. FSIS personnel had conducted a preoperational inspection of this department at approximately 07:50 hours and released its contents. This constitutes a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Animals and Animal Products, Subchapter E, Regulatory Requirements under the Federal Poultry Products Inspection Act, Part 416, Sanitation, Section 13(a). Federally-inspected food production establishments are required to fulfill the expectations of all applicable requirements of the United States Code of Federal Regulations and Food Safety and Inspection Service. In this instance, management failed to perform a preoperational inspection of equipment later used in the production process, failed to document on a preoperational SSOP record that a preoperational inspection had been performed on a piece of equipment used in the production process before the beginning of the next production shift (10/16/2011), or both. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).

Regulation:

416.13(a) Each official establishment shall conduct the pre-operational procedures in the Sanitation SOP’s before the start of operations.
