Citation: October 11, 2011 08:15 hours While performing an unscheduled, 01C02, operational sanitation inspection procedure on the grounds outside the establishment, I observed a white, plastic, square-shaped, bulk bin bearing the word "Edible" on its exterior being transported by forklift from the shipping and receiving dock to the trash compactor adjacent to the USDA designated parking lot. I asked the driver to stop and provide me an opportunity to examine the bulk bin's contents. He immediately complied. Inside this container, I observed discarded plastic box straps, used and soiled waxed cardboard box bodies and lids, used single-use latex gloves, and discarded plastic film. Based on its color and the yellow English word printed on it, this receptacle is identified in this firm's written prerequisite program as permitted for use with edible product only. I rejected the container, a direct food contact surface, by affixing the Food Safety and Inspection Service Form 6502-1 #B39718871. No product was observed to have been involved at this time. This constitutes a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Animals and Animal Products, Subchapter E, Regulatory Requirements under the Federal Poultry Products Inspection Act, Part 416, Sanitation, Section 13(c). Federally-inspected food production establishments are required to fulfill the expectations of all applicable requirements of the United States Code of Federal Regulations and Food Safety and Inspection Service. In this instance, management has failed to prevent a container dedicated for use with edible product from being used to transport garbage. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.
