Citation: October 10, 2011 17:04 hours While performing an unscheduled, 06D01, facilities and equipment sanitation inspection procedure of the establishment's evisceration department en route to the Food Safety and Inspection Service (FSIS) on-line inspection stand #1 to break an FSIS employee from his duties, I observed beaded condensate on multiple surfaces above the principal production line where livers were in the process of being harvested. The condensation was present on the underside of PVC and metal plumbing pipes suspended above the horseshoe in the line near the entrance to the offal room. Stopping to observe, I watched as condensate actively dripped at this location in the compartment from multiple sites above foot traffic zones. I directed an on-line FSIS employee to arrest the production line pending the plant's initiation of corrective action. All product being conveyed through the affected foot traffic zones was adequately covered and no product was seen to have been involved at the time of my observations. This constitutes a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Animals and Animal Products, Subchapter E, Regulatory Requirements under the Federal Poultry Products Inspection Act, Part 416, Sanitation, Sections 1, 2(d), and 4(d). The establishment's QC/HACCP director, Mr. [redacted] was informed of the noncompliances upon receipt of this document. Federally-inspected food production establishments are required to fulfill the expectations of all applicable requirements of the United States Code of Federal Regulations and Food Safety and Inspection Service. In this instance, management has failed to provide adequate ventilation to a food production zone leading to the formation of condensation observed to have been actively dripping during operations and in the presence of product. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).


416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
