Citation: October 9, 2011 11:10 hours While performing a scheduled, 04B04, general labeling requirements inspection procedure inside the establishment's cooler, I encountered forty-two (42) cases of halal chicken product packaged in fully labeled, strapped, waxed cardboard boxes ready for entry into commerce. Each box contained approximately fifteen (15) dressed, unsplit young chicken carcasses and bore today's Julian date, two hundred eighty-two (282), in addition to a Federal mark of inspection. As there were no additional packaging materials, aside from ice, the shipping container also served as the product's immediate container. After contacting the firm's QC/HACCP director, Mr. [redacted] about the matter he spoke with the evisceration department's junior manager, [redacted] who confirmed that these young chickens had been slaughtered and packed on Friday, 10/07/2011, Julian day two hundred eighty (280). I retained the affected product bearing a false pack date by affixing the Food Safety and Inspection Service Form 6502-1 #B40157518. The palletized cases were moved to the establishment's freezer pending implementation of corrective actions. These observations constitute a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Animals and Animal Products, Part 381, Poultry Products Inspection Regulations, Section 126. The establishment's QC/HACCP director, Mr. [redacted] was notified verbally of the noncompliance promptly. Federal law requires that establishments utilize product labeling that is neither false nor misleading and accurately reflects the contents it describes and to which it is applied. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).
Regulation:
381.126a) Either the immediate container or the shipping container of all poultry food products shall be plainly and permanently marked by code or otherwise with the date of packing. If calendar dating is used, it must be accompanied by an explanatory statement, as provided in § 381.129(c)(2).
