Citation: September 21, 2011 10:05 hours While performing a scheduled, 01C02, operational sanitation inspection procedure inside the establishment's new cooler, I observed three (3) plastic bulk bins containing raw, young chicken and young turkey dressed carcasses and parts being stored on the floor, directly above which were two (2) racks of Ready-to-Eat product palletized on wooden pallets. Upon further examination, I noted that one (1) of these bins containing product was incompletely covered with plastic. Located on top of this plastic film I observed two (2) pieces of wood debris, measuring one (1) by four (4) inches and one quarter (1/4) by one (1) inches in sizes, respectively. The other two (2) bulk bins had no covering in place to protect their edible contents. After a visual inspection of the product, I observed no contamination or adulteration. [redacted] a member of management, was present in the cooler at the time of discovery and alerted to the noncompliances. As Mr. [redacted] took immediate and swift corrective actions to restore protection of the poultry products I took no regulatory control action. This constitutes a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Animals and Animal Products, Subchapter E, Regulatory Requirements under the Federal Poultry Products Inspection Act, Part 416, Sanitation, Sections 4(d). Federally-inspected food production establishments are required to fulfill the expectations of all applicable requirements of the United States Code of Federal Regulations and Food Safety and Inspection Service. In this instance, management has failed to ensure that product is protected from contamination while it resides in cold storage on the official premises. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).


416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
