Citation: September 15, 2011 16:50-16:55 hours While performing a scheduled, 01C02, operational sanitation inspection procedure in the tray pack room, the hallway outside the tray pack room, and the processing department, I observed two (2) members of the staff chewing gum and one employee donning facial jewelry. Those employees identified chewing gum, both inside the hallway outside the tray pack room, were discovered doing so in food production environments in the presence of product. The individual donning a silver, metal stud above the right corner of her mouth was observed trimming young chicken breasts with a knife in the tray pack room. This establishment's written Sanitation Standard Operating Procedures (SSOPs) expressly prohibit the chewing of gum and donning of uncovered jewelry in food processing zones as part of Good Manufacturing Practices (GMPs). The facility's QC/HACCP director, Mr. [redacted] the processing department's co-manager, [redacted] and the tray pack room's manager, [redacted] were informed of the noncompliances verbally and upon receipt of this Noncompliance Record (NR). No product was observed to have been involved at this time. Mr. [redacted] has stated in the past that each new employee completes training in GMPs before beginning active employment and signs a document attesting to this fact. This constitutes four (4) failures to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Animals and Animal Products, Subchapter E, Regulatory Requirements under the Federal Meat Inspection Act and the Poultry Products Inspection Act, Part 416, Sanitation, Section 13(c). Federally-inspected food production establishments are required to fulfill the expectations of all applicable requirements of the United States Code of Federal Regulations and Food Safety and Inspection Service, including the implementation and monitoring of written SSOP plans. This document serves as written notification that failure to comply with regulatory requirements may result in further regulatory and/or administrative action(s). Past Similar NRs - Previous Ineffective Plant Actions: Failure to provide adequate training in GMPs to new employees and adequately monitor employees' disregard for the facility's written SSOPs. 416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.
