Citation: September 12, 2011 11:51 hours While performing an unscheduled, 06D01, facilities and equipment sanitation inspection procedure of the establishment's loading dock, I observed a puddle of standing water approximately eight (8) feet wide and four (4) inches in depth at its deepest point adjacent to the shipping and receiving manager's office. The water had accumulated around a drain that was obstructed in some manner or overwhelmed, but apparently unable to convey this quantity of liquid away from the area. The puddle formed from the disposal at or near this location of water used in the kashering process and manual chilling of product. While I rerouted all foot traffic attempting to enter the affected area, an employee moved the standing water to another drain that could accommodate the volume of liquid using a squeegee. Two (2) plastic-lined, cardboard totes of ice, a direct food contact surface, were observed in the immediate vicinity but deemed to be adequately protected from potential contamination at the time of discovery. This constitutes a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Animals and Animal Products, Subchapter E, Regulatory Requirements under the Federal Poultry Products Inspection Act, Part 416, Sanitation, Sections 1, 2(e)(4), and 4(d). The establishment's QC/HACCP director, Mr. [redacted] was informed of the noncompliances upon receipt of this document. Federally-inspected food production establishments are required to fulfill the expectations of all applicable requirements of the United States Code of Federal Regulations and Food Safety and Inspection Service. In this instance, management has failed to direct employees to repair a compromised waste water drain and allow the accumulation of a significant amount of standing water in a foot traffic zone near direct food contact surfaces. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(e)(4) Plumbing. Plumbing systems must be installed and maintained to: Provide adequate floor drainage in all areas where floors are subject to flooding-type cleaning or where normal operations release or discharge water or other liquid waste on the floor;

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
