Citation: September 4, 2011 11:23 hours While performing an unscheduled, 01C02, operational sanitation inspection procedure inside the establishment's freezer, I observed a large stalagmite of ice under the left hand ventilation unit at the rear of the compartment. The ice was located on a warehouse shelving rack and approximately four (4) feet in diameter and three (3) feet in height. After approaching the ice formation that appeared to result from condensed water vapor dripping from under the refrigeration unit, I discovered approximately fifteen (15) unwaxed, cardboard cases of palletized "KJ Breaded Chicken Breasts," a pass-through product, encased in the frozen condensation. An additional eighteen (18), waxed cardboard cases of raw, young chicken wings palletized on the floor of the freezer were also observed to be coated in a glaze of ice approximately one-half (1/2) of an inch thick. I retained the pass-through product and the chicken wings by affixing the FSIS Forms 6502-1 #B39718840 and #B39718841, respectively. This constitutes a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Animals and Animal Products, Subchapter E, Regulatory Requirements under the Federal Poultry Products Inspection Act, Part 416, Sanitation, Sections 4(d) and 13(c). Federally-inspected food production establishments are required to fulfill the expectations of all applicable requirements of the United States Code of Federal Regulations and Food Safety and Inspection Service. In this instance, management has failed to ensure that product is protected from contamination while it resides in frozen storage on the official premises. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
