Citation: July 27, 2011 07:23 hours While conducting an unscheduled, 04C04, ante-mortem inspection procedure of a tractor trailer load of live, young chickens, I observed twelve (12) plastic barrels this establishment identifies by shape as permitted solely for use with inedible product containing condemned poultry waste. The contents of these barrels, including poultry fat, skin, bone, and trimmings, were palletized on the grounds outside the rendering truck bay and an exterior entrance to the offal room. I noted that the contents of these barrels had not been applied with the green, [redacted] denaturant this firm inventories prior to exiting the facility. I rejected the condemned material by affixing the Food Safety and Inspection Service's (FSIS) Form 6502-1 #B39718852. I promptly informed the establishment's live handling area manager, [redacted], of the noncompliance verbally. This constitutes a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Animals and Animal Products, Subchapter E, Regulatory Requirements under the Federal Poultry Products Inspection Act, Part 381, Poultry Products Inspection Regulations, Section 95(c). Federal establishments are required to decharacterize inedible waste produced during a food production process before it leaves the control of production areas by one of the following means: steaming, incineration, or denaturing by the application of chemicals approved by the FSIS Adminstrator. This document serves as written notification that failure to comply with regulatory requirement(s) may result in additional regulatory and/or administrative action(s).
Regulation:
381.95(c) Chemical denaturing, which shall be accomplished by the liberal application to all carcasses and parts thereof, of: (1) Crude carbolic acid, (2) Kerosene, fuel oil, or used crankcase oil, or (3) Any phenolic disinfectant conforming to commercial standards CS 70–41 or CS 71–41 which shall be used in at least 2 percent emulsion or solution.
