Citation: June 5, 2011 13:46 hours While performing an unscheduled, 06D01, Sanitation Performance Standards inspection procedure of the establishment grounds along the northeast exterior of the salting department, I encountered an array of debris and construction material littering the area. The material included four (4) sheets of corrugated aluminum roofing material approximately thirty (30) feet by three (3) feet in size, assorted scrap metal, two (2), fifteen (15)-foot sections of aquamarine PVC sewer conduit, mounds of torn, yellow fiber glass insulation, three (3) empty cardboard boxes, four (4) spent air filters, and a four (4)-foot section of a ventilation duct. As I navigated through the debris, I observed one (1) wood chuck (Marmota monax) scurry into one section of the open sewer conduit. This constitutes a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Section 416.2(a). Mr. [redacted] was promptly notified of the noncompliance upon receipt of this noncompliance record. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).
Regulation:
416.2(a) Grounds and pest control. The grounds about an establishment must be maintained to prevent conditions that could lead to insanitary conditions, adulteration of product, or interfere with inspection by FSIS program employees. Establishments must have in place a pest management program to prevent the harborage and breeding of pests on the grounds and within establishment facilities. Pest control substances used must be safe and effective under the conditions of use and not be applied or stored in a manner that will result in the adulteration of product or the creation of insanitary conditions.
