Citation: April 27, 2011 08:05 hours While performing an unscheduled 06D01, facilities and equipment sanitation inspection procedure in the kashering department, I observed steadily dripping water originating from an overflowing, overhead drip pan located underneath the conveyor belt that moves product from the desalinating baths into the immersion chiller. The equipment's failure to convey its liquid contents directly to a drain was not observed to have been included in the establishment's Plant Improvement Plan after a recordkeeping review at approximately 10:55 hours the same day. This is a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Animals and Animal Products, Sections 416.1 and 416.4(d). The QC/HACCP manager, Mr. [redacted] was notified in writing of these noncompliances upon receipt of this Noncompliance Record. The dripping water was observed to fall in a foot traffic zone neither through nor in which product typically is moved or stored. No product was observed to have been affected on this occasion. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).
Regulation:
416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.
416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
