Citation: March 11, 2011 15:20 hours While performing an unscheduled operational sanitation, 01C02, inspection task in the hallway between the employee handwashing facility and tray packaging department, I encountered a strong odor of burning tobacco. Moving through the plastic curtains into the shipping and receiving area, I observed the establishment's purchasing manager, [redacted] smoking a white, Parliament Silver filtered cigarette. In his immediate vicinity, I further observed a white, plastic combo-tote containing approximately 400 pounds of chicken livers being chilled with ice and one cardboard tote lined with plastic containing approximately 1,500 pounds of ice. Both containers were covered with plastic and sealed with adhesive tape. This constitutes a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Animals and Animal Products, Sections 416.4(d) and 416.13(c). I promptly informed Mr. [redacted] of the noncompliances verbally. Wherever and whenever product itself and ice, a direct food contact surface, are present, those compartments are to be considered areas of production. This establishment's written Sanitation Standard Operating Procedures plan very clearly states that [redacted]. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).
Regulation:
416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.
416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
