Citation: January 23, 2011 07:59 hours While performing an unscheduled operational inspection procedure in the hallway between the tray pack room and employee hand washing facility, I observed peeling and flaking white paint on the northwest, southwest, and southeast walls. I rejected the three affected walls by affixing the Food Safety and Inspection Service Forms #B39718950, # B39718951, and B39718952. I promptly, verbally notified the evisceration department's junior manager, Mr. [redacted] of the noncompliance. This is a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Sections 416.2(b)(1) and 416.4(d). This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).

Regulation:

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
