Citation: December 13, 2010 12:00 hours While performing an unscheduled inspection procedure to assess this establishment's basic compliance with the Federal requirements for microbiological sampling, I observed the written procedure for ensuring randomness in the collection times of samples for Escherichia (E.) coli to include the use of numbered tiles. Mr. [redacted] confirmed that no such tiles exist and that at present they are not using a method of generating random numbers in the implementation of their E. coli sampling program. This is a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Section 381.94(a). I promptly notified Mr. [redacted] of the noncompliance verbally. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).
Regulation:
381.94(a)(1)(i) Criteria for verifying process control; E. coli testing. Each official establishment that slaughters poultry shall test for Escherichia coli Biotype I (E. coli). Establishments that slaughter more than one type of poultry and/or poultry and livestock, shall test the type of poultry or livestock slaughtered in the greatest number. The establishment shall: Collect samples in accordance with the sampling techniques, methodology, and frequency requirements in paragraph (a)(2) of this section;
