Citation: At approximately 1830 hours while performing a operational sanitation procedure I observed the following non-compliance; in the first refrigeration area I observed dripping water from an overhead evaporator unit, and two pallets of chicken liver stored directly under this unit. The pallet to the left side there was 13 cases of packaged but not weighted chicken livers, and on the right side there was 18 cases of packaged and weighted chicken livers. I immediately applied US retained tag # B20443949 to the 13 cases stored under the left side of this evaporator unit and US retained tag # B20443950 to the 18 cases stored under the right side of this evaporator unit. Mr. [redacted] was informed immediately of this non-compliance and he had the product moved immediately. Mr. [redacted] was shown and verbally informed of this non-compliance and relevant regulations 9CFR416.1 which states that an establishment must operate in a manner that will not create insanitary conditions and to insure that product is not adulterated, and 9CFR416.13(c) stating that each official establishment shall monitor daily the implementation of the procedures of the Sanitation SSOP's, and 9CFR416.4(d) stating that product must be protected from adulteration during processing, handling, storage, loading and unloading at and during transportation from official establishments. Mr. [redacted] immediate action was to have all 31 cases rewashed with a chlorine bases water and repackaged under my direct observation. Also the overhead evaporator unit was attended to immediately.
Regulation:
416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.
416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
