Citation: December 8, 2010 11:01 hours While performing an unscheduled preoperational inspection of the establishment's small cooler in which it produces mechanically separated poultry, I noticed the compartment was unusually warm. The refrigeration unit was not operating and beaded condensate was present on its underside. I observed 23 covered, plastic, palletized luggers containing chicken bones from the previous day's production. Using a thermometer furnished and calibrated by the facility on 12/06/10, I took the temperature of one lugger of product. The product registered 43 degrees Fahrenheit. I retained the palletized product by affixing the Food Safety and Inspection Service Form 6502-1 Form #B39718918. This constitutes a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Sections 416.13(c) and 381.66(b). Mr. [redacted] was promptly alerted of the noncompliances verbally. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.
