Citation: December 5, 2010 11:24 hours While conducting a scheduled operational sanitation, 01C02 inspection procedure in the large salting department, I observed three, 55-gallon, blue plastic barrels containing [redacted] palletized next to the large soaker. The establishment uses this chemical as [redacted]. Production was in progress and product was present at the time of my observations. I rejected the three barrels by affixing the Food Safety and Inspection Service Form 6502-1 #B39718921. The salting department's manager, Mr. [redacted] was verbally informed of the noncompliance. As this was an operational inspection, edible product was present in the same compartment as the 165 gallons of [redacted]. The factory seals of the barrels, however, were intact and no product was observed to be involved. This constitutes a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Animals and Animal Products, Section 416.4(c). This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s). Past Similar NRs - Previous Ineffective Plant Actions: Inadequate monitoring by establishment to prevent edible product and chemicals from inhabiting the same compartment simultaneously. NR: 53-2010 dated 7/7/2010

Regulation:

416.4(c) Cleaning compounds, sanitizing agents, processing aids, and other chemicals used by an establishment must be safe and effective under the conditions of use. Such chemicals must be used, handled, and stored in a manner that will not adulterate product or create insanitary conditions. Documentation substantiating the safety of a chemical’s use in a food processing environment must be available to FSIS inspection program employees for review.
