Citation: October 31, 2010 13:07 hours While conducting an operational inspection procedure of the lavatory facilities, I observed an employee wearing a navy blue lab coat labeled "Salting Area" enter a toilet stall without first removing and hanging it on one of the hooks provided outside the compartment. I immediately notified Mr. [redacted] that an employee was wearing his coat inside one of the latrines. He joined me to resolve the situtation. When the employee had exited the compartment, Mr. [redacted] reminded him of the establishment's protocol that prohibits the wearing of uniforms inside the lavatories and instructed him to change into a new coat. I then observed the employee wash his hands without using soap and move to the paper toweling dispenser to begin drying his hands. I asked Mr. [redacted] to direct the employee to rewash his hands using soap. Mr. [redacted] complied with my request, as did the employee. This is a failure to comply with the U.S Code of Federal Regulations, Title 9, Chapter III, Section 416.5(a). Mr. [redacted] was notified verbally of the noncompliance. There are signs written in Spanish posted in the lavatory facilities explaining this company's policy regarding uniforms and the lavatory facilities. I suggested to Mr. [redacted] that the same information also be conspicuouly posted in Yiddish. He agreed and stated that these signs would be posted in short order. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).

Regulation:

416.5(a) Cleanliness. All persons working in contact with product, food-contact surfaces, and product-packaging materials must adhere to hygienic practices while on duty to prevent adulteration of product and the creation of insanitary conditions.
