Citation: September 16, 2010 09:50 hours While performing an operational inspection procedure in the shipping and receiving area, Food Safety and Inspection Service (FSIS) Inspector-In-Charge, [redacted] observed that a sundry of garbage and debris had accumulated on the shipping dock, including: used plastic wrap, discarded plastic box straps, fragments of wooden pallets, soaked waxed cardboard lids and boxes, and dampened cardboard. Inspector [redacted] rejected the entire shipping and receiving area by applying FSIS Forms 6502-1 #B39133047 and #B39133043 to the two overhead dock doors. This represents a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Sections 416.2(b)(2), 416.4(b), and 416.4(d). Mr. [redacted] was immediately informed of the noncompliances verbally. Due to the fact that product is transported through this department throughout the day, it must be cleaned and sanitized at a frequency sufficient to prevent the development of unsanitary conditions. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).
Regulation:
416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.
416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
