Citation: August 25, 2010 08:17 hours While performing an operational inspection of the cooler facilities, Food Safety and Inspection Service (FSIS) Inspector-In-Charge, [redacted] suspected that several cases of mechanically separated chicken located under the establishment's ice machine had not achieved a temperature of 40 degrees Fahrenheit (F) after further processing and packaging. Inspector [redacted] inserted a thermometer calibrated utilizing an ice-water slurry this morning into one of the cases. The thermometer registered a temperature of 47.3F. The lot number, 1023643, on this product indicates that it was packaged at approximately 21:30 hours the previous evening, 11.25 hours ago. Two additional cases registered temperatures of 47.0 and 46.9F. Federal regulations require product to be returned to 40F or below "promptly" after further processing. Inspector [redacted] retained eight (8) cases of mechanically separated chicken bearing the lot number 1023643 by applying FSIS Form 6502-1 #B39133089 to the palletized product. This is a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Section 381.66(b). Mr. [redacted] was immediately verbally informed of the noncompliance. Due to the high pressure that mechanically separated poultry (MSP) is subjected to during its processing combined with its resultant high surface area, this type of processed product is more susceptible to degradation than products composed of whole muscle. Federal regulations for chilling and cooling are intended to maintain the wholesomeness of products intended for human food. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).

Regulation:

381.66(b)(1) General chilling requirements, except for ratites. All poultry that is slaughtered and eviscerated in the official establishment shall be chilled immediately after processing so that the internal temperature is reduced to 40 °F. or less, as provided in paragraph (b)(2) of this section unless such poultry is to be frozen or cooked immediately at the official establishment. Eviscerated poultry to be shipped from the establishment in packaged form shall be maintained at 40 °F. or less, except that during further processing and packaging operations, the internal temperature may rise to a maximum of 55 °F.: Provided, That immediately after packaging, the poultry is placed under refrigeration at a temperature that will promptly lower the internal temperature of the product to 40 °F. or less, or the poultry is placed in a freezer. Poultry which is to be held at the plant in packaged form in excess of 24 hours shall be held in a room at a temperature of 36 °F. or less.
