Citation: August 16, 2010 15:32 hours While performing a Homeland Security inspection procedure in the establishment's motor and maintenance rooms, Food Safety and Inspection Service (FSIS) Inspector-In-Charge, [redacted] observed multiple instances of standing water and an excessive accumulation of debris, litter, and garbage on the floors, including cigarette butts, soiled paper toweling, plastic bags, plastic cups, a Styrofoam cup, used latex and Nitrile gloves, cardboard, industrial engine lubricant, empty containers of food-grade lubricant, plastic bottles, rusted metal detritus, dirt, and mud. Inspector [redacted] rejected these rooms by affixing FSIS Forms 6502-1 #B39133013 and #B39133016 to their entrances. The condition of these rooms is not compliant with the United States Code of Federal Regulations, Title 9, Chapter III, Sections 416.1 and 416.2(b)(2). Mr. [redacted] was immediately verbally notified of these noncompliances. No product is produced or stored in these rooms, but both are only separated from the evisceration department by a 16-step stairway. The establishment is mandated by Federal regulations to maintain the sanitation of all compartments on its official premises to avoid potential contamination and/or adulteration of the edible product it produces. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.
