Citation: August 12, 2010 13:15 hours While performing an operational inspection of the packaging department, Food Safety and Inspection Service (FSIS) Inspector-In-Charge, [redacted] observed nine, 20 to 24-pound waxed cardboard cases containing chicken skin with wing bones intact packaged for retail sale. The shrink-wrap, plastic film bearing the Labeling and Program Delivery Division-approved label was observed to lack the standard of identity, a required labeling element for this type of packaging. Inspector [redacted] retained the nine cases of product by applying FSIS Form 6502-1 #B39133008 to the palletized product. This constitutes a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Section 317.2(c)(1). Mr. [redacted] was immediately verbally informed of the noncompliance. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative actions.

Regulation:

317.2(c) If the product is fabricated from two or more ingredients, the word ‘‘ingredients’’ followed by a list of the ingredients as prescribed in paragraph (f) of this section;
