Citation: August 3, 2010 09:55 hours While performing an unscheduled 01B02 preoperational inspection procedure of the establishment's freezer, Food Safety and Inspection Service (FSIS) Inspector-In-Charge, [redacted] observed extensive soiling of the plastic insulation flaps with mud and other unidentifiable material. Inspector [redacted] rejected the insanitary non-food contact surface by applying FSIS Form 6502-1 #B39133003 to the freezer door and requested that no product be transported into or out of the freezer until the flaps were cleaned or removed. Management complied with this request. This is a failure to comply with United States Code of Federal Regulations, Title 9, Chapter III, Sections 416.4(b) and 416.4(d). These regulations address the facility's obligations to sanitze non-food contact surfaces as frequently as necessary and protect product from adulteration during storage and transport, respectively. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).
Regulation:
416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
