Citation: At approximately 2015 hours, I observed the following while performing an unscheduled 01C02 procedure task in the Fabrication Room; employees packing chicken legs into aluminum trays with lids manufactured by [redacted]. at the Leg Packing line. The chicken legs are in direct contact with the inside food contact surfaces of the aluminum trays and lids. The aluminum trays and lids are used in the final packaging of the chicken leg products. At this time upon request the establishment does not have available a Letter of Guaranty and/ or documents supporting the decisions made in the Hazard Analysis. The establishment has addressed packaging materials at the Receiving Packaging Materials step in the Hazard Analysis on page 4 and has identified [redacted]. The establishments Justification for decision states: "[redacted] ". The establishments Raw Not Ground HACCP Plan was last signed and dated 2/5/10. QC/ Manager, [redacted] Processing co-manager, [redacted] and Processing Co-Manager, [redacted] verbally notified immediately of the non-compliance. This is a failure to meet 9CFR 417.5(a)(1); 9CFR 381.144(a) and 9CFR 381.144(b). This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action(s). The 02 process will be performed.
Regulation:
381.144(a) Edible products may not be packaged in a container which is composed in whole or in part of any poisonous or deleterious substances which may render the contents adulterated or injurious to health. All packaging materials must be safe for the intended use within the meaning of section 409 of the Federal Food, Drug, and Cosmetic Act, as amended (FFDCA).
417.5(a)(1) The establishment shall maintain the following records documenting the establishment’s HACCP plan: The written hazard analysis prescribed in § 417.2(a) of this part, including all supporting documentation;
