Citation: At approximately 2150 hours I observed the following while performing a scheduled 06D01 procedure task of the establishments Facilities: - Employee street clothing (shirt) stored on the top shelf of the storage rack used to store packing materials in the Small Kosher Salting Room. - Soiled frocks stored on benches and tables and soiled/ non-soiled aprons commingled with street clothing and other outer garments along the perimeter of Employee Dressing/ Break Room. - 6" x 10" hole in the wall below employee garment storage hooks exposing insulation at the North East portion of the Employee Dressing/ Break Room. - Scattered trash and debris throughout the floor, under tables, chairs and on the tops of tables, benches and chairs in the Employee Dressing/ Break Room. - Ten unused tray pack trays used to pack various edible retail products with no protective covering stored on the top shelf of the storage rack on the left side upon entrance to the second floor Dry Storage Room. - Beaded condensate on the outside exposed surface of the overhead refrigeration units directly above exposed products on the Leg Packing Machine line upon entrance from the Evisceration Room and on the Poultry Cut-up Line stationed along the East Wall. This is a failure to meet 9CFR 416.1; 9CFR 416.2(h)(1); 9CFR 416.4(b); 9CFR 416.2(b)(1) and 9CFR 416.4(d). [redacted] processing Co-Manager verbally notified immediately of the non-compliances. This document serves as written notification that your failure to comply with regulatory requirements(s) could result in additional regulatory or administrative action.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.

416.2(h)(1) Dressing rooms, lavatories, and toilets. Dressing rooms, toilet rooms, and urinals must be sufficient in number, ample in size, conveniently located, and maintained in a sanitary condition and in good repair at all times to ensure cleanliness of all persons handling any product. They must be separate from the rooms and compartments in which products are processed, stored, or handled.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
