Citation: At approximately 1430 hours, while performing a scheduled 01C02 procedure task I observed the following in West area of the Cooler adjacent the Freezer entrance; water from the ceiling joint seam is steadily dripping into a stainless steel vat in direct contact with duck livers (Foie Gras). The stainless steel vat contains approximately 40 duck livers (Foie Gras) weighing approximately 60 lbs. The stainless steel vat of duck livers (Foie Gras) retained with US Retained tag#B39718898. The establishments SSOP plan signed and dated 2/2/10, page 2 section B. Processing Operations under sub-section 2. Monitoring and Recordkeeping states: "[redacted] ". This is a failure to meet: 9CFR 416.13(c), 9CFR 416.4(a), 9CFR 416.2(b)(1) and 9CFR 416.1. I immediately notified HACCP Coordinator, [redacted] and Production Supervisor, [redacted] verbally of the non-compliance.


416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOPís.

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
