Citation: At approximately 0605, while conducting PreOperational SSOP review and observation, I discovered rusty, dry shackle rails had not been cleaned and oiled as discussed in the weekly meeting of June 1, 2012 between [redacted], FSIS EIAO, [redacted] Quality Control Director, and myself. The rusty, dry rails were discussed and duly noted in last weeks meeting agenda and inspection notes. In the meeting, EAIO [redacted] stated that the rails needed to be in sanitary condition by Monday, June 4, 2012, start of operations. Ms. [redacted] agreed and stated that she would notify maintenance as they would be responsible for cleaning and oiling the rails. On Monday, June 4, 2012, upon pre-op review and observation, the rails had been brought into compliance through evisceration inspection stand lines and no further. At a meeting conducted by Dr. [redacted] with [redacted] and myself again attending, the rusty, dry rails were again discussed and it was again stated that the rails must be brought into compliance. PreOperational SSOP review and observation of today revealed that no further progress had been made on this issue. US Retain/Reject tag B39416910 was affixed to the rails throughout slaughter up to the large chiller. [redacted] Quality Control Assistant Supervisor, was present and immediately notified. [redacted], Third Shift Sanitation Manager, assembled a crew to wipe down and oil the rails.[redacted] has agreed to monitor the condition of the rails throughout the production day and halt slaughter in order to re-oil the rails as necessary to prevent rust dust from adulterating product. Upon this assurance, regulatory control was released.

This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.


416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.13(a) Each official establishment shall conduct the pre-operational procedures in the Sanitation SOPís before the start of operations.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
