Violation:  416.1, 416.2(a), 416.2(b)(3), 416.4(b)

Citation: At approximately 0800 hrs, while performing a directed SPS verification inspection task of the establishments facility the following non-compliances were observed. 1) Evisceration department. two dead flies inside the round light fixture above inspection stand #2. One dead fly inside the round light fixture above the hang back line. 2) Door leading into production does not close completely leaving a 2 inch gap between the top of the door and the door frame. A 1 inch gap on the right hand side of the door between door and frame. The door frame on the left hand side is loose and the blue paint is beginning to peel off. Several pieces of blue paint chips were observed on the ground in front of doorway. 3) Missing plastic strips on the doorway located behind the cooling unit on the left hand side leading from cooler to loading dock leaving an opening about a foot wide from the top of door down to the floor. Broken plastic strips on the doorway leading from loading dock to the outside premises leaving an opening about 4 inches wide from top of door down to the floor. [redacted] was informed of the non-compliances. These findings ae in violation of but not limited to 9CFR 416.1, 416.2(a), 416.2(b)(3) and 416.4(b). This document serves as written notification that your failure to comply with regulatory requirements could result in additional regulatory or administrative action.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(a) Grounds and pest control. The grounds about an establishment must be maintained to prevent conditions that could lead to insanitary conditions, adulteration of product, or interfere with inspection by FSIS program employees. Establishments must have in place a pest management program to prevent the harborage and breeding of pests on the grounds and within establishment facilities. Pest control substances used must be safe and effective under the conditions of use and not be applied or stored in a manner that will result in the adulteration of product or the creation of insanitary conditions.

416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
