Citation: At approximately 0735 hrs, while performing pre-operational inspection after the establishments own pre-operational sanitation was complete and prior to the start of operations in the cut up room the following non-compliance was observed. One red hand hand cart was found stored under the dip tank by chiller with pieces of chicken from previous day's production embedded in the tire grooves and mold like residue on the frame of the cart. 3 more carts were found in the offal room in the same condition. All 4 carts were rejected and tag # B39416943 was applied. These carts are used to transport inedible barrels from product areas to offal room and back. These insanitary conditions are in violation of but not limited to 9CFR 416.1, 416.3(a) and 416.4(b). This document serves as written notification that your failure to comply with regulatory requirements could result in additional regulatory or administrative action.
Regulation:
416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.
416.3(a) Equipment and utensils used for processing or otherwise handling edible product or ingredients must be of such material and construction to facilitate thorough cleaning and to ensure that their use will not cause the adulteration of product during processing, handling, or storage. Equipment and utensils must be maintained in sanitary condition so as not to adulterate product.
416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
