Violation:  416.1, 416.2(a)

Citation: At approximately 0725 hrs while performing pre-operational inspection in the loading dock area the following non-compliance was observed. The room between the loading dock and plant entrance where the shipping office is located had numerous gnats and 3 spiders on the wall as well as several more gnats flying around. The room was rejected and tag # B19929023 was applied. Sanitation manager shipping supervisor and the QC staff were all present at the time of the findings. These insanitary conditions are in violation of 9CFR 416.1 and 416.2(a). A similar NR was witten on 8/24/10 see NR # 0072-2010-14455. This document serves as written notification that your failure to comply with regulatory requirements could lead to additional regulatory or administrative action.


416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(a) The grounds about an establishment must be maintained to prevent conditions that could lead to insanitary conditions, adulteration of product, or interfere with inspection by FSIS program employees. Establishments must have in place a pest management program to prevent the harborage and breeding of pests on the grounds and within establishment facilities. Pest control substances used must be safe and effective under the conditions of use and not be applied or stored in a manner that will result in the adulteration of product or the creation of insanitary conditions.
