Violation:  416.13(c), 416.4(d)

Citation: At approximately 1430 hrs while observing the establishments operational sanitation the following non compliance was observed. Upon walking into the shipping/loading area I noticed the over head cooling units were not functioning properly and the room was warm. I began to take the temperature of the product in the room with a calibrated thermometer provided by the QC staff. 1 pallet with 8 cases of chicken thighs had a temperature reading of 45 degrees and 1 pallet containing 15 cases of chicken legs had a temperature reading of 50 degrees. Both pallets were retained. Tag #'s B30649386 and B30649386 were applied. It is stated in both HACCP and SSOP plans that [redacted]. Shipping department manager and supervisor were notified of the findings. This is in violation of but not limited to 9CFR 416.1, 416.13(c), 381.66(b)(1) and 416.4(d). This document serves as written notification that your failure to comply with regulatory requirements could lead to additional regulatory or administrative action.

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
