Violation:  416.1, 416.2(b)(4), 416.3(b), 416.4(d)

Citation: At 0900 I conducted a scheduled routine SPS Verification. I entered the product storage freezer and observed numerous boxes (over 30+) containing product stored directly on the floor. These were both on the ground below product racks and in the area between racks, in the case of packages of boxed beef. I also observed a ventilation unit with areas of frozen condensation on it. Below this unit was a very large pile of ice (over a foot tall at its height and extending across the walking area), possibly caused by dripping condensation from the unit above, partially covered by an inedible barrel. This inedible barrel was close to touching the edge of a box of product. In addition, encased in the ice was at least one box of product (on the ground). The presence of the icedeterred inspection of that box of product for sanitary conditions, labeling compliance and other duties. Mr. was shown these non-compliances visually, informed of them orally and in writing with this non-compliance report. As always you have the right to appeal.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(4) Rooms or compartments in which edible product is processed, handled, or stored must be separate and distinct from rooms or compartments in which inedible product is processed, handled, or stored, to the extent necessary to prevent product adulteration and the creation of insanitary conditions.

416.3(b) Equipment and utensils must not be constructed, located, or operated in a manner that prevents FSIS inspection program employees from inspecting the equipment or utensils to determine whether they are in sanitary condition.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
